Recommendation to Mostar City

On 24 March 2022, IHROBiH received a complaint concerning the exercise of the right to access information. Mostar City was designated as the respondent party.

IHROBiH considered the complaint and, following the investigation procedure, it ascertained a violation of rights in this specific case. As the competent public body failed to comply with the Freedom of Information Act of the Federation of Bosnia and Herzegovina, IHROBiH sent Recommendation no. P-137/22 on 4 May 2022, instructing as follows:

1. To consider repealing Decision no. UP-I-02-04-9250/22 dated 25 March 2022 and issue a new decision granting the complainant's FOAI request pursuant to the FBiH Freedom of Information Act;

2. To provide answers to applicants in future cases, taking into account the IHROBiH findings and opinions from this Recommendation;

3. To inform IHROBiH of the measures taken to implement the Recommendation.
