Recommendation to Ministry of Spatial Planning, Construction, Environmental Protection, Return and Housing Affairs of Central Bosnia Canton

A complainant from Travnik approached IHROBiH on 8 November 2021 because of a procedure concerning the construction of a mini hydropower plant, claiming that the construction permit was issued without obtaining an energy permit preceding the issuance of a construction permit for new electricity generation facilities, all in line with Article 3 paragraph 2 of the Regulation on the Procedure, Criteria, Format and Content of Energy Permits Applications for the Construction of New and Reconstruction of Existing Production Facilities.

The complainant states that Article 78 paragraph 4 of the Electricity Act of the Federation of BIH, that Article 35 paragraph 2 item g of the CBC Construction Act, clearly stipulating that other attachments as provided for by a separate law shall be enclosed with the construction permit, has not been complied with, and that the final approval of the competent electricity distribution company for the location, project and electricity grid connection has not been enclosed, listed in the Planning Permit as necessary for issuing the construction permit.

Following the investigation, IHROBiH sent Recommendation no P-114/22 to the Ministry of Spatial Planning, Construction, Environmental Protection, Return and Housing Affairs of Central Bosnia Canton, instructing as follows:

To consider cancelling the disputed decision, i.e. to issue a decision to cancel the Mini Hydropower Plant Construction Decision.

To inform IHROBiH of the implementation of the Recommendation within 30 days and provide the decision issued pursuant to this Recommendation.
