Press statement | 06.09.2021 Recommendation regarding the violation of the right to access information by the Ministry of Finance of the Republika Srpska Human Rights Ombudsman of Bosnia and Herzegovina To the Human Rights Ombudsman of Bosnia and Herzegovina, on January 25, 2021 the complainant addressed, regarding the violation of the right to access information by the Primary School "Petar Petrović Njegoš" Banja Luka. He states that on 28 December 2020, a request for access to information was submitted to the School. The request requested the submission of the ranking list of candidates according to the published public competition in the daily newspaper "Glas Srpske" dated 21 October 2020, documentation related to the evaluation of candidates, the decision of the director on the selection of candidates, and a repeated ranking list made after control by the Republic Administration for Inspection Affairs together with the accompanying documentation on the basis of which the scoring was performed. Upon the submitted request, the School responded with act number: 7/21, dated 8 January 2021, stating that the ranking lists were publicly displayed on the premises of the School and as such made available, and that the request could not determine which documentation the applicant appeals accurately claims. In addition, the School's response lacks legal remedies, i.e., a referral to submit a complaint to the competent authority, as well as information on the possibility of addressing the Ombudsman of Bosnia and Herzegovina. After the investigation procedure, the ombudsmen on 06 August 2021 issued a recommendation number: P-209/21, ordering the director of the Primary School "Petar Petrović Njegoš" Banja Luka: 1. Upon receipt of this recommendation, to respond without delay to the complainant to the submitted request for access to information dated 28.12.2020. year, in the manner prescribed by Article 14 of the Law on Freedom of Access to Information in the Republika Srpska 2. To inform the Ombudsman of Bosnia and Herzegovina about the undertaken activities on its implementation within 30 days from the day of receiving the recommendation .
