Press statement | 30.08.2021 Press release Human Rights Ombudsman of Bosnia and Herzegovina On the occasion of marking of 30 August, the International Day of the Victims of Enforced Disappearances, declared by the United Nations, the ombudspersons of Bosnia and Herzegovina express their full support for and solidarity with the members of families of all the disappeared and hereby invite the competent authorities to take all necessary measures to avoid any additional suffering brought on by social, economic and cultural consequences of enforced disappearances. The International Day of the Victims of Enforced Disappearances is of special importance for Bosnia and Herzegovina given the last armed conflict and the fact that in Bosnia and Herzegovina the search is on for people whose fate and gravesites remain unknown. By its nature and pursuant to Article 190a of the Criminal Code of BiH, enforced disappearance constitutes a distinct criminal offence violating a number of human rights, including economic, social and cultural rights, of the disappeared, their relatives and others. The lack of efficient protection of economic, social and cultural rights is also a factor contributing to enforced disappearances. In addition, people living in poverty are more vulnerable and exposed to higher risk of enforced disappearances. The ombudspersons point out that, in addition to being a moral obligation, the resolution of the issue of the disappeared is a legal obligation, which is why it is necessary for all competent bodies in BiH to take responsibility and take adequate action.
