Decision of the Regional Court in Doboj

The complainant Cvijanoviić Borka from Doboj in her complaint registered within the Ombudsman under number Ž-BL-04-176/16 dated 18 March 2016 claimed that she was a victim of an irresponsible and degrading act of communication by the Director of Internal Audit Department of the Republika Srpska Railways and that her professional and personal rights are violated. She addressed the Management Board of the Railways Company, the Audit Board, the General Director and the Executive Directors and the Internal Audit Department Director, but did not receive any response.

Following the investigation conducted by the Ombudsman pursuant to the provisions of the Law on Human Rights Ombudsman of Bosnia and Herzegovina and Law on Prohibition of Discrimination in Bosnia and Herzegovina based on victimization of the complainant in violation of Article 4 paragraph 3 and Article 18 of Law on Prohibition of Discrimination in Bosnia and Herzegovina, using legal powers vested in Ombudspersons they issued a recommendation no.: P-135/16 to the General Manager of the Railways of Republika Srpska, and Director of the Internal Audit Department to take all necessary measures to stop the mobbing, redress its consequences and prevent any future recurrence of it against the employees. General Manager replied that he thought that this recommendation should not have been directed to him, while Director of the Internal Audit Department failed to reply.

The complainant sought the court protection. The Basic Court of Doboju in its decision no.: 85 0 Rs 057239 16 Rs established the violation of the complainant’s rights, and the Regional court in Doborj in its decision no. 85 0 Rs 057239 17 Rsž dated 19 April 2017 upheld the decision of the Basic Court.
