Press statement | 03.04.2017 The Ombudsman issued Recommendation zo The Municipal Court in Sanski Most Human Rights Ombudsman of Bosnia and Herzegovina Referring to the practice and opinion of the European Court of Human Rights in Strasbourg, Human Rights Ombudsman of Bosnia and Herzegovina have established a violation of the rights of a lengthy trial under Article 6 § 1 of the European Convention on Human Rights and Fundamental Freedoms in the case on complaint of J. V. Complainant turned to the Ombudsman of Bosnia and Herzegovina in connection with proceedings pending at the Municipal Court in Sanski Most. She alleged that the claim was lodged in 2014 and that the aforementioned procedure has already been the subject of consideration by the Ombudsman of Bosnia and Herzegovina. According to the complainant, the court processing the case still has not taken any procedural activity. In accordance with the Rules of Procedure of the Institution of Ombudsman for Human Rights of Bosnia and Herzegovina, the court was asked for explanation. In the submitted response the court chronologically explained in what manner and when it acted in the case, which show that allegation on taking no procedural steps in the case is not true. However, despite these facts, it is established the violation of the right to trial within a reasonable time and the court has been forwarded the Recommendation No: P-65/17. The Ombudsmen recommended the President of the Court, within the scope of his/her responsibilities, to take appropriate actions and measures concerning commenced proceedings on the claim of the complainant be as quickly as possible continued and completed, and inform them about the activities undertaken to implement the recommendations.
