Not Accepted Initiative to Amend The Law on Pre-School Education of Tuzla Canton

Ombudspersons of Bosnia and Herzegovina initiated the amendments to the Law on Pre-School Education of Tuzla Canton since the Article 48, paragraph 1 of the Law on Pre-School Education of Tuzla Canton does not comply with the Framework Law of Bosnia and Herzegovina ("Official Gazette of BiH" No. 88/07) in part listing necessary qualifications for pre-school education teachers which reads "and persons with a degree in social sciences/humanities" means that it includes all those who had completed any faculty of social sciences/humanities (graduate lawyer, economist, journalist, or even graduate criminologist etc.). can be a teacher in pre-school education, which is in the opinion of the Ombudsman inadmissible.

Ombudspersons emphasize that such an important field as the pre-school education cannot be „not regulated“and margin of interpretation should not be wide. On the contrary, criteria and standards should be clearly defined and followed, in particular in respect of qualifications of persons to be hired for work in pre-school institutions.

Article 29 paragraph 2 of the Law on Pre-School Education of Bosnia and Herzegovina provides the following:

„... Different programs of preschool care and education n in public and private sector shall be implemented by educators, specialized experts (pedagogues, specialized pedagogues, speech therapists, psychologists, doctors, social workers) with university degree “. This provision clearly defines what experts (pedagogues, specialized pedagogues, speech therapists, psychologists, doctors, social workers) can be engaged in work in the area of pre-school education.

In concrete case, on 25 November 2016 the Municipal Assembly of Tuzla Canton replied to the Ombudsman in a letter which said that they asked the opinion of the Ministry of Education, Science, Culture and Sports of Tuzla Canton of the Ombudsman’s initiative.

On 12 December 2016 the Ministry replied as follows: „we think that the mentioned provision is harmonized with Framework Law of Bosnia and Herzegovina and additionally extended.“

Ombudspersons call upon the all ministries of education to review their related acts and harmonize it with relevant legislation governing this field.
