Press statement | 11.07.2016 Ombudspersons recommended initiation of the amendment to the Rulebook on marking the vehicles driven by the persons with disabilities procedure Human Rights Ombudsman of Bosnia and Herzegovina Ombudspersons of Bosnia and Herzegovina issued their Recommendation no. 117/16 dated 13 June 2016 to the Ministry of Communication and Transport of Bosnia and Herzegovina recommending them to initiate procedure to amend the Rulebook on marking the vehicles driven by the persons with disabilities or in which persons with disabilities are transported ("Official Gazette of Bosnia and Herzegovina”, no. 92/15). The Rulebook on marking the vehicles driven by the persons with disabilities or in which persons with disabilities are transported, in the opinion of Ombudspersons, comprises discriminatory provisions in respect of conditions for obtaining the accessibility label by the minors compared to the adult persons with disabilities. Namely, provisions of the applicable Rulebook foresee that a pre-condition for an adult person to be granted an accessibility label is to have disability degree established, which fully serves the purpose intended by issuance of the accessibility label. However, for minor persons with disabilities In addition to the above pre-condition they have to prove the ownership over the vehicle of their parents or legal guardians. Such a legal solution, in the opinion of Ombudspersons is unjustified because it creates non-equality between the minors and the adults with the established 100% disability degree that could only be transported by car. Ombudspersons of Bosnia and Herzegovina are inviting the authorities to implement and apply the principles established in the international documents, in concrete case, the UN Convention on the Rights of Persons With Disabilities.
