Press statement | 24.05.2016 Ombudsperson of Bosnia and Herzegovina issued a recommendation related to Addressing complaints within a reasonable time Human Rights Ombudsman of Bosnia and Herzegovina Having conducted its investigation pursuant to Rules of Procedure of the Institution of Human Rights Ombudsman of Bosnia and Herzegovina in accordance with Article 32 of the Law on Human Rights Ombudsman of Bosnia and Herzegovina, Ombudspersons of Bosnia and Herzegovina issued their recommendation to the Prime Minister of the Federation of Bosnia and Herzegovina to teke efficient measures in order to halt enforcement of the decisions/conclusions of the Administration for War Veterans, Social Affairs and General Administration of the Municipality of Ljubuški. Ombudspersons of Bosnia and Herzegovina decided to investigate allegations of the complainant despite the fact that he had used regular legal remedies and in that sense his right to fair trial under Article 6 paragraph 1 of European Convention on Human Rights and Fundamental freedoms was not violated. Ombudspersons of Bosnia and Herzegovina have examined his complaint from the aspect of unreasonable duration of the enforcement procedure of the decisions/conclusions of the Administration for War Veterans, Social Affairs and General Administration of the Municipality of Ljubuški adopted back in 2011. Ombudspersons of Bosnia and Herzegovina in their recommendation indicated to the fact that the state has the obligation to organize decisions enforcement procedure in a way to be efficient, either at the rights level, or in practice and that the state must ensure that decisions and judgments are enforced without unjustified delays. From the aspect of both human rights and legal certainty, Ombudspersons of Bosnia and Herzegovina think that the rights of access to court does not imply only a formal access to court, that is, the access serving its own purpose, but it means an efficient access to trial which last until the established civil right is implemented.
